Legal Background

Her resignation follows closely on a judicial panel determined that she had been unlawfully serving as the top prosecutor. This ruling is expected to impact many prosecutions in New Jersey.

The court said that a temporary posting that skirted the advice and consent of the Senate breached the Federal Vacancies Reform Act.

It was also stated that the former prosecutor will stay on at the justice department as a high-level advisor. Habba plans to seek further review of the court's action, in the hope of achieving a overturned decision.

In a statement, Bondi contended that the judiciary "must not override the appointment of attorneys tasked with executing the primary duty of the administration of enforcing the law."
